Listing of materials and resources on this website should not be construed or interpreted as an endorsement by Spark Growth. The inclusion of links is not intended to endorse any views expressed on these outside sites, or the organizations sponsoring the sites. Spark Growth does not control or guarantee the quality of this outside information. Spark Growth reserves the right to delete messages from the bulletin boards because of offensive language or for any other reason. However, Spark Growth cannot verify the identity or good faith of those who post messages and Spark Growth does not necessarily endorse any of the opinions expressed on any of the bulletin boards. The following rules govern the use by you of Spark Growth. The rules set forth herein apply to all materials, online communications, and other information that is or becomes available on Spark Growth (collectively, "Information"). BY SIGNING ON AND USING SPARK GROWTH, YOU SPECIFICALLY AGREE TO ABIDE BY THESE RULES AND ANY MODIFICATIONS THERETO. 1. Personal Uses Permitted. No material from Spark Growth or any website owned, operated, licensed, or controlled by SPARK GROWTH may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except that you may download one copy of the materials on any single computer for your personal, non-commercial home use only, provided you keep intact all copyright and other proprietary notices. Modification of the materials or use of the materials for any other purpose, WITHOUT THE PRIOR WRITTEN CONSENT OF SPARK GROWTH, is a violation of SPARK GROWTH's copyright and other proprietary rights. All trademarks, servicemarks, and trade names are proprietary to the Spark Growth program. 2. User's Obligation to Abide By Applicable Law. The violation of applicable Intellectual Property Laws may give rise to civil and/or criminal penalties. 3. Disclosure of Online Communications. You are cautioned that any online communications may not be fully confidential. In addition, you should be aware that federal postal regulations do not protect electronic mail. You should be aware that some administrative personnel of Spark Growth may, in the course of their regular duties, have access to communications for technical or operational purposes. Spark Growth may also disclose any communications to the extent permitted or required by law. 4. Prohibition Against Rogue Programming. You shall not post, transmit, or make available in any way through Spark Growth any software or other materials which contain a computer virus, trojan horse, timebomb, worm, or other rogue programming ("Rogue Programming"). Spark Growth has no obligation to detect the presence of any Rogue Programming. Any downloading of software or other materials or any other use of the Information on Spark Growth is at your risk, and you are advised to take adequate precautions to minimize any loss to your system caused by Rogue Programming, including use of anti-virus programs and proper backup of files. 5. Content of Information. You are responsible for the content of any Information you put on Spark Growth. SPARK GROWTH has no obligation to, and does not in the normal course, monitor or control any Information that is or becomes available on Spark Growth. SPARK GROWTH reserves the right to review any Information that is or becomes available on Spark Growth. SPARK GROWTH reserves the right to refuse to post or to remove any Information that is, in SPARK GROWTH's sole discretion, unacceptable, undesirable or in violation of these rules. However, SPARK GROWTH has no obligation to exercise such reservation of rights by SPARK GROWTH. 6. Disclaimer of Warranties. SPARK GROWTH IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF TITLE, NONINFRINGEMENT, OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SPARK GROWTH DOES NOT WARRANT THAT ANY INFORMATION IS COMPLETE OR ACCURATE, THAT SPARK GROWTH WILL BE UNINTERRUPTED OR ERROR FREE OR THAT ANY INFORMATION IS FREE OF ROGUE PROGRAMMING. 7. Limitation of Damages. UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL SPARK GROWTH BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES THAT MAY RESULT FROM THE USE OR INABILITY TO USE SPARK GROWTH, INCLUDING WITHOUT LIMITATION USE OF OR RELIANCE ON INFORMATION AVAILABLE ON SPARK GROWTH, INTERRUPTIONS, ERRORS, DEFECTS, MISTAKES, OMISSIONS, DELETIONS OF FILES, DELAYS IN OPERATION OR TRANSMISSION, NONDELIVERY OF INFORMATION, DISCLOSURE OF COMMUNICATIONS, OR ANY OTHER FAILURE OF PERFORMANCE. 8. Release and Indemnity. YOU HEREBY RELEASE AND WAIVE ANY AND ALL CLAIMS AND/OR LIABILITY AGAINST SPARK GROWTH ARISING FROM OR IN CONNECTION WITH YOUR USE OF SPARK GROWTH. YOU ALSO AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS SPARK GROWTH FROM AND AGAINST ANY AND ALL CLAIMS OR LIABILITY, INCLUDING COSTS AND ATTORNEYS FEES, ARISING FROM OR IN CONNECTION WITH YOUR USE OF SPARK GROWTH OR FAILURE TO ABIDE BY APPLICABLE LAW. 9. Thank you for visiting SPARK GROWTH. SPARK GROWTH is committed to protecting your privacy and maintaining your trust. B. SPARK GROWTH Donors Most of SPARK GROWTH’s Websites offer users the opportunity to make a donation in support of SPARK GROWTH, or a particular project of SPARK GROWTH. You may also make a donation to SPARK GROWTH by phone or by mail. To make a donation you must provide personally identifiable information including, but not limited to, your name, address, credit card number or information for another payment method. To provide the highest level of security possible to protect your personally identifiable information, SPARK GROWTH may hire trusted third parties to process your donations. How SPARK GROWTH Uses Your Information SPARK GROWTH uses your information, both personally identifiable and non-personally identifiable, to provide you with a requested service, improve your experience while visiting our Websites and to improve SPARK GROWTH’s communication with you outside of the SPARK GROWTH Websites. SPARK GROWTH also analyzes the information we collect for the overall aggregate trends such information reveals about our site visitors. Privacy of Children SPARK GROWTH is very proud to provide high-quality children’s television programming and Web content. Working to maintain the privacy of the many children who make use of SPARK GROWTH’s services is of the utmost importance. SPARK GROWTH’s policy is not to collect personally identifiable information of children. Some of the SPARK GROWTH Websites do allow children to participate in Website activities. For example, LD Online provides the opportunity to submit children’s drawings or writings for publication to the site. Parents may request the removal of any work submitted by their child. The SPARK GROWTH Websites do not collect more information from children than is reasonably necessary for the child to participate in activities, and SPARK GROWTH discards children’s information once the activity is complete. SPARK GROWTH will not entice children, by the prospect of a special game, prize or other activity, to provide more information than is necessary to participate in an activity. SPARK GROWTH also will not share any personally identifiable information about children with third parties. 5.
